P. Ramulu, v. G. Lakshminarayana Goud,
THE HON'BLE DR. JUSTICE SHAMEEM AKTHER M.A.C.M.A. No. 264 OF 2006 JUDGMENT:
This appeal is filed under Section 173 of the Motor Vehicles Act, 1988, by the appellant-petitioner in O.P. No.2207 of 2000 on the file of the Chairman, Motor Accidents Claims Tribunal-cum- V Additional Chief Judge, City Civil Court, Hyderabad (for short, 'the Tribunal'), having got dissatisfied with the award of compensation of Rs.60,000/- with interest at 9% per annum granted by the Tribunal, vide the order dated 30.06.2004, for the injuries sustained by him in a motor accident.
2.
No representation for the appellant. Whereas, learned Standing Counsel respondent No.2 is present and contends that the compensation awarded is adequate and reasonable and no indulgence of the Court is required in this matter. 3.
Now the short point for consideration in this matter is, whether the compensation awarded by the Tribunal is just or not? 4.
It is evident from the evidence of P.Ws.1 and 2 and the documents Exs.A.1 to A.8, wherein the details of the injuries sustained by the appellant-petitioner are recorded. Ex.A.6disability certificate discloses the disability suffered by the appellant-petitioner. After considering the evidence on record, both oral and documentary, the Tribunal determined the total compensation of 60,000/-, i.e., Rs.25,000/- towards compound fracture of both bones of left leg and right wrist, Rs.15,000/- towards disability, Rs.10,000/- towards pain and suffering and
Rs.10,000/- towards transportation to hospital, extra nourishment, medicines and damage to clothes. The Tribunal has given elaborate reasons for determining the said compensation of Rs.60,000/-. Viewing from any angle, there is no justification to enhance the compensation as pleaded by the appellant. 5.
Under these circumstances, the present appeal is lacking merits and, accordingly, it is dismissed. There shall be no order as to costs. Miscellaneous Petitions, if any pending in this appeal, shall stand closed.
