THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.24890 of 2016 ORDER :

The petitioner, who was employed as Assistant Divisional Engineer (Electrical) in the respondent organisation, was an accused in a criminal case C.C.No.1654 of 2012 before the XIV Additional Chief Metropolitan Magistrate, City Criminal Courts, Nampally, Hyderabad on a complaint lodged by her colleague one A.Vivekanand.

On that ground, the petitioner was not considered for promotion to the next cadre Divisional Engineer (Electrical) and other attendant benefits were also denied to her.

Ultimately, the said criminal case ended in acquittal of the petitioner on 26-07-2016.

Thereafter, the petitioner made a representation on 24-10-2016 bringing to the notice of the respondent the fact that C.C.No.1654 of 2012 ended in her favour and sought promotion to the post of Divisional Engineer (Electrical) as well as attendant benefits such as increments etc. On 15-11-2016, the respondent promoted the petitioner as Divisional Engineer (Electrical). 5.

Petitioner contends that attendant benefits including further promotion, increments etc. were not extended to petitioner although in

MSR,J W.P.No.24890 of 2016 -2the counter-affidavit dt.23-11-2016, the respondent has promised to extend all other attendant benefits as well.

Sri N.Siva Reddy, learned Standing Counsel for respondent states that the respondent will extend all attendant benefits as agreed in para-7 of the counter-affidavit within two months from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of directing the respondent to consider petitioner's representation dt.24-10-2016 and extend all attendant benefits due to petitioner such as further promotion, increments etc, to which she is entitled to, and communicate its decision to petitioner within two (02) months from the date of receipt of a copy of this order. No costs. 8.

As a sequel, miscellaneous petitions pending if any, shall stand closed.
