THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5831 of 2019 O R D E R:

Petitioners assert that pursuant to the building permit, dated 05.07.2017, they are making constructions in the subject premises and that there are no deviations. While so, respondent No.4Assistant City Planner, Circle No.21, GHMC, Chandanagar, Hyderabad, issued a notice, dated 05.02.2019, to the petitioners alleging that they are making constructions in deviation to the sanctioned plan. Their grievance is that though they submitted their explanation on 27.02.2019 to the impugned notice, the respondent authorities did not consider the same till date. Hence, this writ petition.

Learned Standing Counsel appearing for respondent Nos.2 to 4 submits that in deviation to the sanctioned plan, the petitioners constructed the third floor and thereafter, laid centring for construction of penthouse and on noticing the same, after issuance of notice, the same was demolished and once again, the petitioners are making efforts to make construction and it is only to avoid the action being taken by the authorities, they filed the present writ petition.

In the light of the above and having considered the grievance of the petitioners that the explanation submitted by them has not been considered by the respondents, the writ petition is disposed of with the direction to respondent No.3-Deputy Commissioner, Circle No.21, GHMC, Chandanagar, Hyderabad to take into consideration

the explanation submitted by the petitioners and pass appropriate orders within a period of one week from the date of receipt of a copy of this order and communicate the same to the petitioners. Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:20.03.2019 kdl
