HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.19235 of 2015 ORDER:

Heard.

Alleging inaction on the part of the 1st respondent in disposing of the interim application filed along with the revision petition on 01-06-2015, against the order in ROR Appeal No.6 of 2014, dated 02-05-2015, the present writ petition is filed.

The petitioner states that respondents 2 and 3 filed an application before the 4th respondent on 10-07-2013 seeking mutation of their names in the revenue records. The 4th respondent, after conducting detailed enquiry, dismissed the application vide order, dated 14-11-2014. Aggrieved thereby, respondents 2 and 3 filed an appeal before the Revenue Divisional Officer, Kothagudem.

The Revenue Divisional Officer, Kothagudem, without following the due procedure and without issuing any notice, taken a contrary view and accordingly, allowed the appeal. The petitioner, therefore, preferred a revision before the 1st respondent along with stay application. Since the stay petition is not being taken up, the petitioner has moved this Court by way of present writ petition.

In the circumstances, therefore, it is appropriate to direct the 1st respondent to hear the appeal or atleast the interim application seeking stay and take appropriate decision, after issuing notice to respondents 2 and 3, if necessary, as expeditiously as possible, preferably within four weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
