THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 39455 OF 2014 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue Writ, order or direction more in the nature of the Writ of Mandamus declaring the action of the Respondents in not completing the investigation in Crime No.268/2014, dt.21-6-2014, registered under Secs.451, 427, 506, 34 IPC & 3(1)V, 3(1)X of the S.C., S.T., (Prevention of Atrocities) Act, 1989, on the file of Nellore V Town Police Station, as illegal, arbitrary and in violation of Article 14, 19 and 21 of Constitution of India and consequently direct the Respondents to file final report in Crime No.268/2014, dt.21-6-2014, on the file of Nellore V Town Police Station, and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."
2. When the matter is called today, learned Government Pleader appearing for the respondents has placed on record the written instructions dated 23.01.2015 furnished by the Sub-Divisional Police Officer, Nellore Town Sub Division, SPS Nellore District. According to the said instructions, the Additional Public Prosecutor (Grade-1) and Special Public Prosecutor, Special court for SCs and Sts cases, Nellore, after verifying the files is of the opinion that it is a fit case to refer as false. It is further stated in the written instructions that proposals have been sent on 10.01.2015 to the Superintendent of Police, SPS Nellore District for obtaining orders from the Inspector General of Police, South Coastal Zone, Guntur Range, Guntur, to refer the case as false. It is also stated that after obtaining permission and after serving notice to the complainant, the final report will be submitted before the concerned Court at the earliest.
3. On noticing the said instructions, it is requested by the learned counsel for the petitioner that the said instructions may be recorded and the writ petition may be closed.
4. In view of the above, Writ Petition is closed, recording the written instructions dated 23.01.2015 furnished by the Sub-Divisional Police Officer, Nellore Town Sub Division, SPS Nellore District. It is also made clear that the police authorities shall expedite the process.
5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 30th July, 2015 ss
