HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3574 of 2015 ORDER:
The instant petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, by the petitioners, who are arraigned as A.2 to A.9 alleged to have committed the offences punishable under Sections 307, 323, 324, 498-A, 504, 506 IPC and Sections 3 and 4 of the Dowry Prohibition Act, requesting to quash the FIR.No.71 of 2015 of II Town Police Station, Nalgonda District. As seen from the complaint and FIR, there are direct allegations so far as petitioner Nos.1 and 2 are concerned. Admittedly, A.1, who is the husband of the de facto complainant - second respondent herein, is not a party to the instant proceedings.
Heard both sides.
It is not a fit case where proceedings in Crime No.71 of 2015 can be quashed as no abuse of process of law is to be found at this stage. But, however, to the extent of petitioner Nos.3 to 8 herein who are accused Nos.4 to 9 viz. Sri Syed Mujeebuddin; Sri Syed Sirajuddin; Smt Shaheen Sultana; Smt Ishrath Sultana; Meraj Muneer Syed; and Smt Naseem respectively, the II Town Police, Nalgonda District are directed not to arrest them during the course of investigation. However, they are directed to cooperate with investigating agency by appearing before police as and when asked for smooth completion of investigation.
The Criminal Petition is, accordingly, disposed of.
As a sequel thereto, miscellaneous applications, if any, also stand disposed of.
