HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5828 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in considering the complaint vide No.20/2018 dated 23.5.2018 regarding the issuance of e-pass book and Rythu bandu cheques for the lands in survey No.162/A/1 extent Acs.3.86 and in Survey No.162/A/1 extent of Ac.0.86 cents situated at Munjampally village, Bejjur Mandal, Komuram Bheem-Asifabad District, as arbitrary, illegal and contrary to the provisions of the Telangana Rights in Lands and pattadar pass books Act, 1971 and the rules framed thereunder and also violative of Articles 16 and 300A of constitution of India and consequently direct the respondents to consider the complaint vide No.20/2018 dated 23.5.2018 and pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the record reflects that the Tahsildar concerned already issued Form IB dated 01.11.2017 incorporating the name of the petitioner in the revenue records as against the subject lands. Having done so, it is not open to the Tahsildar concerned to remain inactive upon the petitioner's request for issuance of a new pattadar pass book in relation to the subject lands to enable him to avail the benefit of the Government's Rythu Bandu scheme. The Writ Petition is accordingly disposed of directing the Tahsildar, Bejjur Mandal, Komuram Bheem-Asifabad District, to take appropriate action upon the petitioner's complaint bearing No.20/2018 dated 23.5.2018 in accordance with the due procedure expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
