O R D E R
This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/Accused Nos.1 to 5 and 8 seeking enlargement on bail in connection with Crime No.13 of 2026 of Nizamabad V Town Police Station, Nizamabad District. The offences alleged against the petitioners are under Sections 109, 118(1), 115(2) r/w 3(5) of the BNS.

The brief facts of the case are that, on 22.01.2026, the defacto complainant lodged a report before the police stating that on
- 2 - 22.01.2026, while complainant brother was present at house, at that time complainant brothers colony member informed complainant brother through phone that "One unknown person quarrelling with his son and beating him at Baba Kirana shop. Upon that complainant brother went to Baba Kirana shop and pushed that unknown person. Then that unknown person went to his house and they hatched a plan to kill Mohammed Zaheer and went to Baba Kirana shop and as per their plan they quarreled with Mohammed Zaheer for pushing their person and bet him with rods, sticks and hands. At that time father of Mohammed Abdul Kadar namely M.A. Rasheed Rajvi reached the spot, they bet M.A. Rasheed Rajvi with rods and sticks. Then they decided to kill one of them (i.e. Mohammed Zaheer or M.A. Rasheed Rajvi), as per their plan, accused Nos.
2 and 3 caught hold complainant brother Mohammed Zaheer with their hands with intention to kill him, at that time A.1 stabbed in Mohammed Zaheer stomach with intention to kill him with a knife, which is brought along with him and the complainant's brother Mohammed Zaheer received stab injuries in stomach and received blood injuries and also M.A.
- 3 - shifted them to Govt. Hospital, Nizamabad for treatment. Hence, the complainant requested the police to take necessary action. Basing on the said complaint, the police registered a case for the alleged offences.

Heard Sri Alluri Divakar Reddy, learned counsel for the petitioners as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of the learned counsel for the petitioners is that the petitioners are innocent of the said allegations and accused No.8 is in jail since 23.01.2026 and accused Nos.1 to 5 are in jail since 02.02.2026. It is further contended that, even according to the remand case diary, accused No.1 also sustained injuries in this case and even though he sustained injuries, the present case is registered against accused No.1 also and the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to them by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, contending that the allegations against the petitioners are serious in nature and they have not received the injury
- 4 - certificate and as injured sustained stabbed injuries, at this stage, the petitioners are not entitled for the bail and he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it is evident that accused No.8 is in jail since 23.01.2026 and accused Nos.1 to 5 are in jail since 02.02.2026. As per the remand case diary, prosecution witnesses LWs.1 to 11 have already been examined and even according to the prosecution, the injured person was discharged from the hospital. Considering the overall facts and circumstances of the case, the stage of investigation and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioners, subject to the following conditions: i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned IV Additional Judicial First Class Magistrate, at Nizamabad.
ii.
The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or
- 5 - till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
