THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.5914 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a writ order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in considering the complaint vide No 15/2018 dated 23.5.2018 regarding the issuance of E-pass book and Rythu bandu cheques for the lands in survey No.164/AA/1 extent Ac.10.00 situated at Munjampally village, Bejjur Mandal, Komuram Bheem Asifabad District as arbitrary and illegal and contrary to the provisions of the Telangana Rights in Lands and pattadar pass books Act and rules framed thereunder and also violative of Article 16 and 300A of constitution of India consequently direct the respondents to consider the complaint vide No.15/2018 dated 23.5.2018 and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

Perusal of the record reflects that the petitioner was already issued a regular pattadar pass book under the Telangana Rights in Land and Pattadar Pass Books Act, 1971.

Having received the complaint made by the petitioner in relation to issuance of a new pattadar pass book, the Tahsildar concerned cannot remain inactive in such circumstances.

The writ petition is disposed of directing the Tahsildar, Bejjur Mandal, Komuram Bheem Asifabad District, to take appropriate action upon the petitioner's complaint bearing No.15 of 2018 dated 23.05.2018 for issuance of an e-pattadar pass book expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date:22.03.2019 GJ
