THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5979 of 2020 ORDER:
It is the case of the petitioners that petitioner No.1 is the owner of House bearing No.11/69/1 admeasuring 808.2 square meters, H.No.11-25-37 admeasuring 189.79 square meters, H.No.11-69/2 admeasuring 1113.55 square meters and Part of H.No.11-25-37 admeasuring 398.79 square meters; petitioner No.2 is the owner of H.No.11-25-37/2 admeasuring 444.73 square meters and part of H.No.11-25/37/1 admeasuring 468.21 square meters; and petitioner No.3 is the owner of H.No.11-25-37/1 admeasuring 452.33 square meters, part of H.No.11-25/37/1 admeasuring 468.21 square meters. 2.
The grievance of the petitioners is that without initiating any proceedings or issuing any notice, the respondents are threatening to demolish the subject properties.

Learned Standing Counsel had placed on record the written instructions received from the Commissioner, Greater Warangal Municipal Corporation, along with proceedings, dated 15.02.2011, and also the lay-out plans.

Learned Standing Counsel, while denying the allegations of the petitioners, submits that as the petitioners have made constructions even in an extent of 272.38 square meters pertaining to the area occupied by the roads without any permission and running a school,
the respondent authorities would take necessary action in accordance with law.

The fact of the matter is, as on date no notice was issued to the petitioners. In those circumstances, if there are any violations in the constructions alleged to have been made by the petitioners, it is for the respondent authorities to issue notice to the petitioners calling for their explanation and pass necessary orders in accordance with law after considering such explanation.

Subject to the above, the writ petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No costs.
