HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.12740 of 2005 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Revenue for respondents.

2. It is the case of the petitioner that his mother submitted an application for assignment of land to the first respondent in the year 1977. After conducting enquiry, the first respondent assigned dry land of an extent of Acs.5-00 cents in R.S.No.498/A/2C, situated at Somarajupalli Village in favour of the mother of the petitioner and from the date of assignment, the petitioner and his mother have been in possession of the said land. The mother of the petitioner expired in the year 1982. The petitioner earlier filed W.P.No.15955 of 1997 and the same was disposed of on 22.07.1997 by directing the respondents 1 and 2 therein not to interfere with the possession of the land of the petitioner without canceling the assignment made in his favour. The petitioner also filed O.S.No.

8 of 1997 on the file of the District Munsiff, Kandukur against third parties and the same was compromised in Lok Adalat and an Award was passed on 03.07.2004. Since the Government land is abutting the land of the petitioner, there were threats of encroachment and in those circumstances, the petitioner submitted a representation dated 03.11.2004 for conduct of survey and demarcation of his land. When the same was not done by the respondents, the present Writ Petition was filed.

3. The learned counsel for the petitioner submitted that even though the required amount was deposited in the Government treasury on 05.11.2004, no action was taken by the respondents on the representation of the petitioner dated 03.11.2004. The

respondents have not filed any counter-affidavit so far. 4.

In the circumstances, the Writ Petition is disposed of directing the respondents to consider the representation of the petitioner dated 03.11.2004 and take necessary action in accordance with law within a period of three months from the date of receipt of a copy of this order. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
