THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.312 of 2016 ORDER:

1. This Criminal Revision Case is filed by the petitioner-Accused aggrieved over the order dated 19.1.2016 passed in Crl.M.P.No.22 of 2016 in C.C.No.326 of 2012 by the Special Judicial Magistrate of First Class (Mobile Court), Nellore.

2. Heard and perused the material available on record.

3. The petitioner is facing trial in the above C.C. for the offence punishable under Sections 138 r/w 142 of the Negotiable Instruments Act. As the petitioner did not attend before the trial Court, NBWs were issued against her. Therefore, she filed the above Crl.M.P. seeking to recall NBWs issued against her on 1.3.2013. The trial Court dismissed the above Crl.M.P. Aggrieved by the same, the petitioner filed this revision.

4. Heard and perused the material available on record.

5. Considering the facts and circumstances of the case, the petitioner is directed to surrender before the learned Magistrate and move an application afresh to recall NBWs issued against her. On such application being filed, the learned Magistrate is directed to recall NBWs issued against the petitioner on her executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand) with one surety for the like sum to the satisfaction of the learned Magistrate. The petitioner is further directed to appear before the learned Magistrate regularly on all hearing dates.

6. Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions pending, if any, shall stand closed.
