THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.14857 of 2016 ORDER:
The petitioner, who is the sole accused in crime No.285 of 2016 of Inthezargunj Police Station, Warangal District, filed the present application under Section 438 of the Code of the Criminal Procedure seeking release in the event of his arrest in connection with the above crime registered for the offence punishable under Section 448 IPC and Section 3 (1) (s)(r) of SCs & STs (POA) Act. On 24.09.2016 at about 1140 hours, the informant lodged a written report stating that on 23.09.2016 at about 7.45 p.m. the accused came to his Gym Centre on money matter, pounced upon him and abused him by touching his caste. Basing on these allegations, the present report came to be lodged. Heard the learned counsel for the petitioner as well as the Additional learned Public Prosecutor.
A perusal of the material on record itself would indicate that there exists some money disputes between the accused and the informant. It is the case of the petitioner that when the petitioner asked the informant to repay the loan amount, present report came to be lodged. Having regard to the above, the petitioner is directed to surrender before the Court below within ten days from today and move an application for grant of bail, after giving prior notice to APP, in which event, he shall be released on bail on the same day on his executing a personal bond for Rs.20,000/- (Rupees Twenty thousand only) with two sureties for like sum each to the satisfaction of the Court below. Further, the petitioner shall
appear before the SHO, Inthezargunj Police Station, once in a week i.e. on every Saturday between 10.00 a.m. and 5.00 p.m. for a period of eight weeks or till filing of charge sheet, whichever is earlier.
