S.Sai Babu, v. Executive Engineer, E.G.District.
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.13545 OF 2002 ORDER:
1.
This writ petition is filed seeking the following relief: "... to issue an order, direction or writ particularly one in the nature of Writ of Mandamus or any other appropriate writ, order or direction (I) declaring the action of the respondents in not regularizing the services of the petitioner as arbitrary and illegal, and (ii) consequently, to direct the respondents to regularize the services of the petitioner with all consequential benefits."
2.
Heard Sri T.S. Venkata Ramana, learned Counsel for the petitioner and learned Standing Counsel appearing for the respondent-Corporation.
3.
Learned Counsel appearing for the petitioner submits that since the petitioner has been continuously working since 1.10.1986, without any interruption, he is seeking regularization of his services.
4.
Learned Standing Counsel appearing for the respondentCorporation contends that proposals have been submitted by the respondent-Corporation to the Government to regularize the services of the similarly situated persons in terms of G.O.Ms.212, dated 22.4.1994.
5.
Having considered the rival submissions made by the learned Counsel on either side, this Court is of the view that ends of justice would be met if a direction is issued to the petitioner to submit a representation to the respondentCorporation seeking regularization of his services. 6.
Accordingly, the Writ Petition is disposed of directing the petitioner to submit a representation to the respondentCorporation seeking regularization of his services within a period of one week from the date of receipt of a copy of the order and on receipt of such representation, the respondentCorporation shall consider the same and pass appropriate orders within a period of four weeks thereafter. No costs. Miscellaneous petitions, if any, pending shall stand closed. ________________________________ JUSTICE ABHINAND KUMAR SHAVILI 31st October, 2018 Nn
