HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION Nos.19041 & 19175 of 2017 COMMON ORDER:

Heard learned counsel for the petitioners in both the writ petitions and also the learned Government Pleader for Land Acquisition for respondents 1 to 3 and recorded the offer to file vakalath and counter by Sri A.Pandu Ranga Rao, learned standing counsel for respondent No.4-Municipal Corporation saying he got instructions and received written instructions from learned Government Pleader for Land Acquisition and perused the prayer in the writ petition with supporting affidavit and the material on record.

The written instructions received by the learned Government Pleader for Land Acquisition itself indicates the survey numbers of the petitioners not covered by the earlier award.

Having regard to the above, it is their duty if at all they want this strip of land also to initiate proceedings and but for that, they shall not interfere with the rights, possession and enjoyment of the petitioners.

Accordingly and in the result, these Writ Petitions are disposed of and the respondents shall not dispossess the petitioners except through due process of law. Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
