Heard learned counsel for the petitioner and learned Government Pleader for Home appearing for the respondents. 2.

This Writ Petition is filed alleging that police are calling the petitioner to police station even though no complaint is registered against him and the same is violative under Article 21 of the Constitution of India.

Learned Government Pleader for Home, based on the written instructions furnished by the Sub-Inspector of Police, Luxettipet Police Station, Mancherial District, dated 25.03.2019, submits that Crime No.199 of 2018 was registered on 13.12.2018 based on the allegation that certain people followed the complainant from Adilabad to Luxettipet in their Car to Car of LW.4 by saying as 'trial' and also taken an amount of Rs.30,30,000/- from LW.2 saying that the police are continuing election code. During the course of investigation, accused Nos.1 and 2 confessed that they have given some part of money to one Nandu and Anirud. Based on the said confession, petitioner was shown as accused No.6 and when notice under Section 41A Cr.P.C. was sought to be served on him, he refused to take the same. He further submits that steps are taken to serve the same through registered post. 4.

Since crime was already registered, it cannot be said that police cannot conduct investigation and in the process of conducting investigation, police can call the accused for eliciting

information. Therefore, the contention of the petitioner that police are unnecessarily interfering with the life and liberty of the petitioner is not valid.

The Writ Petition is accordingly dismissed. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
