THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26928 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction on the part of the second respondent in disposing of the revision along with the stay application filed by the petitioner, as arbitrary and illegal.

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies (A.P.)

3. A perusal of the record reveals that the petitioner was appointed as Fair Price Shop Dealer in respect of Shop No.8, Diddekunta Village, Simhadripuram Mandal, Y.S.R. Kadapa District on permanent basis in the year 1994. While so, on 22.09.2014, the fourth respondent issued a show-cause notice calling for the explanation from the petitioner. Being not satisfied with the explanation submitted by the petitioner, the fourth respondent initiated enquiry. The fourth respondent passed orders on 11.10.2014 cancelling the authorization of the petitioner in respect of Fair Price Shop No.8. Feeling aggrieved by the orders of the fourth respondent, the petitioner preferred an appeal before the third respondent. The third respondent dismissed the said appeal on 29.07.2015 confirming the orders of the fourth respondent. Aggrieved by the same, the petitioner filed a revision petition along with stay application before the second respondent.

4. The only point urged by the learned counsel for the petitioner is that the second respondent may be directed to dispose of the stay application filed by the petitioner. The learned Assistant Government Pleader for Civil Supplies also consented for the same.

5. Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both parties, the second respondent is hereby directed to dispose of the stay

application filed along with the revision petition by the petitioner, as expeditiously as possible, preferably within a period of fifteen (15) days from the date of receipt of a copy of this order.

6. With the above direction, the Writ Petition is disposed of. No costs.

7. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
