HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT APPEAL No.273 of 2018 JUDGMENT: (ORAL) (Per Suresh Kumar Kait, J) Vide the present appeal, appellant has challenged order dated 05.02.2018 passed in I.A.No.1 of 2018 in W.P.No.3333 of 2018 by the learned single.

The aforesaid order is not on record and to that effect, appellant has filed application to dispense with filing of certified copy of the same. The appellant is against the notice issued in the aforesaid I.A., and not suspending the proceedings bearing No.A2/3499/2017 dated 19.01.2018 of the 3rd respondent.

Learned counsel for the appellant submits that as per A.P. Ministerial Service Rules, 1998, the appellant has to qualify only in typewriting test in one of the languages, i.e., Telugu/Hindi/Urdu/English for the post of L.D.Typist. Fact remains that appellant was appointed on compassionate grounds under G.O.Ms.No.612, GAD (Services-A) Department dated 30.101.1991, wherein it is specifically stated as under: "Where typewriting in English (Higher) and Telugu (Higher) is an essential qualification for appointment to a post, the candidates who do not possess those qualifications may be considered for appointment to such categories of posts subject to the condition that they should acquire such qualifications within two years after such appointment."

SKK, J & AKS, J W.A.No.273 of 2018 The appellant was appointed on 14.06.2011. She did not challenge the said scheme of compassionate appointment till issuance of proceedings dated 19.01.2018.

As we are not inclined to interfere with the proceedings pending before the learned single Judge, without recording any opinion on merits, we dismiss the appeal. No order as to costs. As a sequel, miscellaneous petitions, if any pending, shall stand closed.
