N. Suryanarayana v. The Government Of Andhra Pradesh Rep. By Its Principal
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.150 of 2014
ORDER
Learned counsel appearing for the petitioners contended that he is member of the 7th respondent-society and in spite of his repeated requests, the authorities are not conducting audit to the 7th respondent-society for the last 45 to 50 years. It is further contended that inspection under Section 52 of the A.P.Co-Operative Societies Act, 1964 (for short 'the Act') was conducted and report under Section 51 of the Act was also submitted on 21.12.2015 and the enquiry report also reveals that no audit was conducted to the 7th respondent. It is prayed that appropriate orders be passed in the writ petition directing the Registrar of Co-operative Societies to take action in pursuance of enquiry report under Section 51 of the Act. Learned Government Pleader appearing for the respondents contended that enquiry report under Section 51 of the Act has been submitted to the Registrar of Co-operative Societies and the Registrar would take further necessary action.
Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that this writ petition can be disposed of directing the Registrar of Co-operative Societies to take further action in
pursuance of enquiry report dated 21.12.2015 submitted by the enquiry officer under Section 51 of the Act, and pass appropriate orders within a period of three months from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending, shall stand closed.
