This Writ Petition is filed challenging the action of the respondents in not considering representations of the petitioner, dated 15.07.2017 and 17.07.2017, for mutation and issuance of pattadar passbooks and title deeds in respect of lands to an extent of Ac.2.20 cents and Ac.5.00 cents in Survey Nos.406 and 406 respectively, situated in Jugguthanda Village, Navabharath Area, Palwanch.

Learned Government Pleader did not get instructions, in spite of granting sufficient time.

The petitioner states that the aforesaid property belongs to her maternal grandfather by name K.Kanakaiah, who acquired the same in the year 1972. While so, the said Kanakaiah has given the entire land to his younger daughter, who is none other than mother of the petitioner, under an unregistered Settlement Deed, dated 31.03.1992. The said Kanakaiah died on 22.11.1995. Thereafter, the mother of the petitioner executed a Settlement Deed in respect of above property in her favour on 28.05.1996. The name of maternal grandfather of petitioner is being continued in the revenue records and now by virtue of above succession, the petitioner applied for mutation as well as issuance of pattadar passbooks and title deeds in her favour. When no action was taken, the present Writ Petition was filed.

A perusal of the record shows that the petitioner did not apply for mutation of her name in the revenue records as per the provisions

of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. Therefore, the petitioner is given liberty to submit an application in the prescribed proforma for the relief sought for by her in the writ petition. As and when such an application is received, the third respondent shall consider the same and pass appropriate orders in accordance with law, within a period of four (04) weeks from the date of receipt of the application.
