HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION Nos.4924 & 4929 of 2018 COMMON ORDER:
Heard learned counsel for the respective petitioners, learned Government Pleaders for Municipal Administration & Revenue respectively for respondent Nos.3 & 4 and learned Standing Counsels i.e., Smt. P. Laxmi for 1st respondent and Sri Ajay Kumar for 2nd respondent and perused the prayer in the respective writ petitions with the supporting affidavits and other material on record.
It is the further averment from the respective affidavits of the 2 petitioners that unauthorizedly the respondents are taking law to their hands and demolished the existing structures of the petitioners in their private properties in plot Nos.20 & 21 in S.No.141 under the pretence of road widening. Whereas it is the submission of the learned Standing Counsel for respondent Nos.1 & 2 from the oral instructions that they did not demolish any private construction in the private properties of the petitioners, but for the encroachment of the road. It is also the submission that they are not laying any road in any private property.
Having regard to the above and by recording the same, both the Writ Petitions are disposed of with a direction to the respondents to demarcate the properties in the presence of the petitioners to cause demarcate and if it is not the private property of the petitioners covered by plot Nos.20 & 21 in S.No.141 and if it is road poramboke, they can lay road if any.
Dr. SSRB,J Consequently, miscellaneous petitions, if any shall stand closed. No costs.
