THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.16070 of 2002 ORDER:

This Writ Petition is filed seeking the following relief: " To issue a Writ, Order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent in not considering the case of the petitioner for compassionate appointment and not disbursing to her the death benefits as arbitrary, discriminatory and illegal and consequently direct the respondent to appoint the petitioner on compassionate grounds to any suitable post and further direct the respondent to disburse the death benefits forthwith with all other consequential benefits monetary and otherwise."

Heard Sri V.Jagapathi, learned counsel for the petitioner and the learned standing counsel for the respondent university. It has been contended by the petitioner that her husband was a regular employee of the respondent University in the cadre of Assistant Professor. While he was discharging his duties, he died in harness on 14.3.2002 leaving behind the petitioner, her minor daughter. The petitioner had submitted representations on 28.3.2002 and 5.8.2002 requesting the respondent university to consider her case for appointment on compassionate grounds and to disburse the pensionary benefits of her husband. It has been further contended by the petitioner that the respondent university had not passed any orders on the said representations. This Court having considered the submissions made by the parties, is of the considered view that this writ petition can be disposed of directing the respondent university to consider the representations submitted by the petitioner.

Accordingly, the Writ Petition is disposed of directing the respondent university to consider the representations submitted by the petitioner on 28.3.2002 and 5.8.2002 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order, if not already disposed of.
