THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.230 OF 2014 ORDER:

This civil revision petition is filed under Section 22 of the A.P. Buildings (Lease, Rent & Eviction) Control Act, 1960, challenging the order dated 25.11.2013 in I.A. No.192 of 2013 in R.C. No.168 of 2012 on the file of the IV Additional Rent Controller, Hyderabad.

The petitioner-tenant filed I.A. No.192 of 2013 seeking to dismiss R.C. No.168 of 2012. The trial court dismissed the said I.A., by the impugned order dated 25.11.2013. Aggrieved by the said order, the petitioner-tenant preferred the present revision petition and obtained stay of all further proceedings in R.C. No.167 of 2012.

None appeared on behalf of the petitioner on 19.4.2017, 20.4.2017 and today also, in spite of the fact that the matter is listed under the caption "For Orders".

The learned counsel for the respondents-landlords submitted that the respondents have filed Memo in S.R. No.1324 of 2015 dated 29.12.2015 before the Rent Controller with a prayer to dismiss R.C.No.168 of 2012. He further submitted that in view of the stay granted by this court, the Rent Controller could not pass the order on the Memo. In view of the submissions made by the learned counsel for the respondents, this court is not inclined to go into the merits of the main case.

Accordingly, the civil revision petition is disposed of, directing the learned IV Additional Rent Controller, Hyderabad to pass the orders on the Memo as expeditiously as possible. Miscellaneous petitions if any pending in this petition shall stand closed.
