This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri Saidam Laxminayana, Advocate for the Petitioner and the Fublic Prosecutor on behalf of the Respondent No.1 .

THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.2174 OF 2023 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short'Cr.P.C.) by the petitionerAccused to quash the proceedings against him in FIR No.34 of 2023 pending on the file of Station House Officer, Begumpet Womens Police Station, Hyderabad, filed for the offences punishable under Sections 498-4, 506 of Indian Penal Code (for short "IPC') and Sections 4 and 6 of Dowry Prohibition Act.

Heard learned counsel for the petitioner - Accused and learned Additional Public Prosecutor for the respondent - State. Perused the material on record.

3. The 2nd respondent - de facto complainant was married to accused No.l on 18.08.2021 and at the time of marriage, certain dowry was also given. After her marriage, she joined accused No.1. Thereafter accused No.1 along with his family members harassed the 2nd respondent physically and mentally for additional dowry.

Since the complaint is outcome of differences between spouses, this Court deems it appropriate to direct the Investigating Officer in respect of FIR No.34 of 2023 pending on the file of Station House Officer, Begumpet Womens Police Station, Hyderabad, to conclude investigation without taking any coercive steps against the petitioner herein. Further, the petitionerAccused shall co-operate with the Investigating Officer as and when required for the purpose of investigation.
