This petition is filed seeking to quash the complaint filed by the Food Inspector, Division-I, Warangal District, which was numbered as C.C.No.18 of 2011 on the file of the Additional Judicial First Class Magistrate, Mahabubnagar, Warangal District, against the petitioners-accused Nos.1 to 3.

The learned Public Prosecutor (T.S.) takes notice for respondent Nos.1 and 2. Heard learned counsel for the petitioner and learned Public Prosecutor.

The single point on which the petitioner's counsel seeks to quash the C.C. is that the sample in this case was lifted on 20.09.2010, where as the Prevention of Food Adulteration Act, 1954 was repealed on 29.07.2010. Counsel for the petitioner also brings to the notice of this Court's order, dated 20.01.2017, in Criminal Petition No.12990 of 2011, in which the petition was allowed on the same ground.

Hence, in terms of the aforesaid order, this Criminal Petition is also allowed quashing C.C.No.18 of 2011 on the file of the Additional Judicial First Class Magistrate, Mahabubnagar, Warangal District, against the petitioners-accused Nos.1 to 3.
