THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.32941 of 2015 ORDER :

The petitioner had executed the work of construction of a causeway and improvement of bund at Shakapur Village along with certain additional works under an agreement dt.28.05.2008 entered into with the 2nd respondent.

2. The petitioner contends that although he completed the work in 2008 itself, no payment had been made and although petitioner was requesting the respondents for making payment, ultimately the impugned letter No.PJP/DD2/D4 86M dt.08.05.2015 had been issued to petitioner stating that Vigilance and Enforcement authorities have raised certain objections with regard to work executed by petitioner.

3. Although the counsel for petitioner disputes the objections raised by the Vigilance and Enforcement Department which are communicated to petitioner by the impugned letter, having regard to the fact that these are disputed questions of fact which can be properly adjudicated in a Civil Court after taking evidence, and also expert evidence, if required, granting liberty to petitioner to approach the competent Civil Court for appropriate relief, this Writ Petition is dismissed. No order as to costs.

4. As a sequel, miscellaneous petitions pending, if any, in this Writ

Petition shall stand closed.
