THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.9497 of 2012 ORDER:

The grievance of the petitioner was that the Station House Officer, Chityal Police Station, Warangal Rural, Warangal District, registered a crime against him without there being any material placed by the fourth respondent implicating him. The said crime was registered as Crime No.31 of 3012 on the file of Chityal Police Station, Warangal District.

Relying on the written instructions dated 21.08.2015 received from the Sub-Inspector of Police, Chityal Police Station, Warangal District, the learned Assistant Government Pleader for Home informed this Court that upon the complaint lodged by the fourth respondent before the learned Judicial Magistrate of First Class, Parakal, Warangal District, which was forwarded to the police authorities, Crime No.31 of 2012 was registered under Sections 498-A and 506 I.P.C. read with Section 6 of the Dowry Prohibition Act, 1961, on the file of Chityal Police Station. The petitioner herein is no other than the brother-in-law of the fourth respondent's husband.

However, after due notice, the police authorities found that the complaint lodged by the fourth respondent against her husband and the petitioner herein was false and accordingly a final report under Section 173 Cr.P.C. stating to that effect was filed before the learned Judicial Magistrate of First Class, Parakal, Warangal District, on 30.05.2013. In the light of the afore-stated development, the grievance of the petitioner as to the registration of a crime against him without sufficient basis is borne out but, in the light of the subsequent action of the police authorities in filing a final report referring the case as false, no interference is warranted in this case.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
