SMT. JUSTICE T.RAJANI Criminal Petition No.13814 of 2013 ORDER:

This criminal petition is filed seeking to quash the proceedings in C.C. No.283 of 2012 on the file of the Judicial First Class Magistrate at Godavarikhani. It is filed for the offence under Section 138 read with 142 of N.I. Act.

A cheque is admittedly issued by the complainant. The learned counsel for the complainant submits that there was another notice issued to the petitioner earlier to the present notice but he does not seek to produce any such notice.

Since the complaint is filed within the limitation, the petitioner is at liberty to raise all the grounds, as raised in this petition, before the Court below.

With the above, this petition is dismissed.
