The grievance of the petitioner is that he made application for sanction of full pay and allowances in terms of G.O.Ms.No.342, Social Welfare (B3) Department, dated 30-08-1977 for prosecuting M.Sc (PHE) at ICMR, Pondicherry for the academic years 2015-17and the same was rejected by impugned memo No.4017/F1/2016-1, dated 31-07-2017. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that the petitioner is very much eligible for sanction of amount in terms of G.O.Ms.No.342, dated 30-08-1977, but the 1st respondent without giving any reasons simply rejected the same.
Heard learned Assistant Government Pleader for Services.
A reading of the impugned memo dated 31-07-2017 goes to show that no reasons are given as to why it is not feasible for consideration of the claim of the petitioner. Hence, the impugned memo is set aside and the 1st respondent is directed to reconsider the application of the petitioner and pass speaking order.
Accordingly, the writ petition is allowed to the extent indicated above. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
