HONOURABLE SRI JUSTICE M.S.K. JAISWAL WRIT PETITION No.15109 OF 2005 ORDER:

This writ petition is filed for declaring the notice dated 22.06.2005 and the order of the 1st respondent passed in Lr.No.CGM/(Expr)/SAO(Rev)/JAO-IIT/D.No.337/05, dated 16.03.2005, as illegal and arbitrary.

In the course of hearing, it has come out that for the self same relief, the writ petitioner has preferred O.S.No.425 of 2003 on the file of Principal Junior Civil Judge, Srikalahasti, Chittoor District. It is also on record that the said suit was dismissed on 31.07.2007.

In that view of the matter, nothing survives for adjudication, since the suit, which is comprehensive in nature was dismissed.

The writ petition is accordingly disposed of with liberty to the petitioner to avail alternative remedies available to him, as per law. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
