ORDER:
The petitioners, who claimed to have taken 2,486 Sq. yards of land in Sy. No.41/11/A of Kanapet, Serilingampally Mandal, Ranga Reddy District, from their owner for development, filed this writ petition, alleging that respondent No.2 has been unduly causing interference with the developmental activities. At the hearing, Mr. Sanisetty Venkateswarlu, learned counsel for the petitioners, has not disputed that so far layout has not been sanctioned by respondent No.2. Even if
the petitioners have a legal right over the land in question, they cannot commence developmental activities in preparing a layout without obtaining sanction from respondent No.2. In this view of the matter, I am not inclined to restrain respondent No.2 from interfering with the proposed developmental activities of the petitioners. However, the petitioners are permitted to file an application before respondent No.2 for sanction of the layout and on receipt of such application, respondent No.2 shall consider the same, take an appropriate decision in accordance with law, and communicate the same to the petitioners.
Subject to the above directions, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.38197 of 2015 shall stand disposed of as infructuous.
