THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2244 of 2016 ORDER:

This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioners-Accused Nos.3 & 4 seeking to quash the proceedings against them in Crime No.18 of 2016 on the file of Nizamabad V-Town Police Station, Nizamabad District. Heard and perused the material available on record. The offences alleged against the petitioners are punishable under Sections 20(b) of Narcotic Drugs and Psychotropic Substances Act and 9

(1) of the A.P. Gaming (Matka) Act. The case of the petitioners is that only on the basis of the confession of the other accused, they were added as accused. The truth or otherwise of the above allegations can be ascertained during the investigation. The Investigating Agency has the power to investigate the case even on the basis of the confession of accused. Since the material on record prima facie reveals allegations against the petitioners, this Court is not inclined to quash the proceedings against the petitioners.

Hence, the Criminal Petition is dismissed.
