This appeal is filed under Section 173 of the Motor Vehicles Act, 1988, by the appellant-insurance company challenging the Judgment and decree, dated 14.10.2005, in O.P.No.56 of 2002 on the file of Motor Accidents Claims Tribunal-cum-Principal District Judge, East Godavari District, Rajahmundry.

Respondents 1 and 2 herein are the claimants. A perusal of the record reveals that the appeal was dismissed for default against respondent No.1 herein on 14.07.2016. Respondent No.2 herein is a minor, represented by respondent No.1. Since the appeal was dismissed for default against the claimants, no purpose will be served by keeping the matter pending. 3.

Accordingly, the appeal is dismissed. Miscellaneous petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs.
