THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.24078 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in interfering with the Building Construction works carrying at TS No.538-1, Premises vide D.No.25-527, Ward No.25, Parthasarathi Nagar, Dharmavaram Town and Municipality, Ananthapuramu District pursuant to the Building permission order vide Permit No.1002/0017/B/DMM/PEN/2016 dated 23.06.2016 without considering the representation dated 21.06.2017 for grant of permission to the additional dug Cellar portion as arbitrary, illegal, contrary to law, principles of natural justice and violative of Articles 14, 21 and 300-A of Constitution of India and also contrary to the procedure contemplated under The AP Municipality Act."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.2 to consider the representation, dated 21.06.2017, of the petitioner and pass appropriate orders in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.2 is hereby directed to consider the representation, dated 21.06.2017, of the petitioner and pass appropriate orders in accordance with law as expeditiously as

possible. Till disposal of the said representation, respondent No.2 is directed not to take any coercive steps against the petitioner. 4.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
