HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15505 OF 2002 ORDER:

This writ petition is filed seeking to declare the action of the respondents in not extending the revised pension duly taking into account the service rendered by the petitioner prior to admission into grant-in-aid, as illegal and arbitrary.

When the matter is taken up for hearing, it is noticed that the petitioner has not challenged the Act 35 of 2005, which was enacted during the pendency of the writ petition and as long as Act 35 of 2005, is not challenged, the relief sought in the writ petition cannot be granted.

In view of the same, the writ petition is dismissed. No order as to costs.
