IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH [Special Original Jurisdiction] WEDNESDAY THE TWENTIETH DAY OF APRIL, 2016 PRESENT Between:
Kotha Veeresham & Ors. ... Petitioners V/s.
The Registrar, Kakatiya University, Warangal & Ors. ... Respondents Counsel for the Petitioner: Sri Namavarapu Rajeshwara Rao Counsel for the Respondents: Sri Adhi Venkateshwar Rao SC for Kakatiya University GP for Revenue The court made the following: [order follows]
O R D E R :
The petitioners pray for mandamus declaring the action of first respondent/Registrar of Kakatiya University, Warangal in causing interference to petitioners possession and enjoyment of Plot Nos. 7 and 9 in Survey No. 29/A of Lashkar Singaram village, Hanamakonda Mandal, Warangal district as illegal and contrary to Article 300-A of the Constitution of India.
2. I have perused the material placed along with the writ affidavit. Prima facie, this Court is of the view that the alleged rights of petitioners on one hand and the assertion of first respondent of its entitlement to any land in survey No.29/A cannot and could not be gone into in this writ petition. The petitioners have to work out their remedies as available in law including applying to the second respondent for survey in the presence of first respondent. Such an application is made by the petitioners to second respondent, this Court is of the view that the second respondent considers the said application in accordance with law
and in the presence of first respondent and Revenue Department appropriate orders of identification of property are passed.
3. The writ petition is disposed of. No costs.
4. As a sequel, miscellaneous petitions if any, pending in this Civil Revision Petition shall stand closed. ___________________ JUSTICE S.V. BHATT 20/4/2016 I s L
