THE HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1255 of 2015 ORDER:

This Revision is filed by the accused No.1 challenging the judgment dated 29.6.2015 in Crl.A.No.22 of 2014, whereby the learned VI Additional Sessions Judge, Kakinada dismissed the appeal confirming the Judgment passed in C.C.No.191 of 2013, dated 28-01-2014, whereby the petitioner/accused No.1 was convicted and sentenced to suffer Simple Imprisonment for 6 months and to pay fine of Rs.500/- and in default, simple imprisonment for 15 days for the offence punishable under Section 411 I.P.C.

After arguing for some time, learned counsel for the petitioner confined his argument only to the extent of quantum of sentence. Considering the facts and circumstances of the case and in view of the mitigating circumstances, the conviction imposed by the trial Court as confirmed by the lower appellate Court is confirmed. But the sentence of imprisonment imposed by trial court as confirmed by the lower appellate Court is hereby set aside and modified to the period already undergone by the petitioner. The fine amount is not interfered with. The revision is allowed to the extent as indicated above. Miscellaneous petitions, if any, filed in this revision shall stand closed.
