ORDER:
This writ petition is filed for a mandamus to declare the action of the respondents in refusing to receive the petitioner's application for building permission for construction of new building by dismantling the exiting building over southern portion of the premises bearing No.1-7-495/7, admeasuring 73.77 sq.yds. out of 220 sq.yds. situated at Hari Nagar, Zamisthanpur, Hyderabad, on the pretext of nonenclosing Town Survey and Land Records (TSLR) certificate and 'No Objection' certificate (NOC) as illegal and arbitrary.
After arguing the case, Mr.P.Achutham Reddy, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to first approach respondent No.1 with the application for grant of building permission and issue a legal notice to it, in the event, it does not receive the application without TSLR certificate and NOC from the revenue authorities. The Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.53638 of 2015 filed by the petitioner for interim relief shall stand dismissed as infructuous. ______________________________ C.V.NAGARJUNA REDDY, J 22nd December, 2015 GHN
