HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10697 OF 2016 ORDER:

The writ petition is filed challenging the action of the respondents in insisting the petitioners to repay the loan instalments to be paid for the year, 2015-16 though there is a draught conditions in Tekmal Mandal of Medak District. It is the case of the petitioners that on account of the drought in Tekmal Mandal Medak District, they are unable to repay the loans said to have been borrowed for the purpose of purchasing the agricultural machinery. It is stated that there is a drought problem on account of the peculiar situation arising at this particular area. Hence, the present writ petition.

Having considered the circumstances of the case and especially in view of the peculiar situation arising in the area of the petitioners, the writ petition is disposed of giving liberty to the petitioners to approach the 3rd respondent-Chief Executive Officer of Cooperative Society by making applications offering repayment schedule within a period of one week from the date of receipt of copy of the order. Thereafter, the 3rd respondent shall take decision on the applications of the petitioners within a period of one week from the date of receipt of the applications. Till such time a decision is taken up on the applications of the petitioners, there shall be stay of all further proceedings pursuant to the demand notices dated 02.03.2016 issued by the respondents-authorities.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions if any pending in this writ petition shall stand closed. ______________________________ CHALLA KODANDA RAM, J Dated:01.04.2016.
