HONOURABLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No. 14303 of 2016 ORDER:

This Criminal Petition is filed seeking to grant custody of case property, i.e. Jeep Commander 650 DL bearing Registration No. AP.15AC 2915 which was seized in connection with Crime No. 142 of 2016 on the file of Station House Officer, Police Station, Yalal, Ranga Reddy District.

Having heard the learned Counsel on either side and gone through the material papers, it is clear that it is for the petitioner to approach the competent authority seeking release of the seized goods and he cannot directly approach this Court seeking release of the seized goods.

In the circumstances, this Criminal Petition is disposed of giving liberty to the petitioner to approach the competent authority/Deputy Commissioner, Prohibition and Excise seeking release of the seized goods. As and when such petition is filed, the competent authority/Deputy Commissioner, Prohibition and Excise, shall dispose of the same, on merits and in accordance with law, within a period of one week from the date of receipt of the application from the petitioner.

Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. No order as to costs.
