HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.15626 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner, learned Asst. Solicitor General for the 1st respondent and Sri P. Rajasekhar, learned standing counsel for the 2nd respondent.

2. The present writ petition is filed to withhold the retiral benefits of the 3rd respondent, who is going to retire from service on 24.06.2015.

3. The remedy open to the petitioner is to approach appropriate court and obtain orders seeking maintenance, but the petitioner cannot straightaway invoke the jurisdiction under Article 226 of the Constitution of India to withhold the retiral benefits of the 3rd respondent.

4. Having regard to the facts and circumstances of the case, the writ petition is not maintainable and hence, the same is dismissed at the stage of admission. However, the petitioner is at liberty to approach appropriate forum and obtain orders seeking maintenance. Miscellaneous petitions in this writ petition, if any, shall stand closed. No order as to costs.
