THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION No.45896 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in not considering the petitioner's objections by way of representation dated 26.03.2016, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Government Pleader for Land Acquisition (A.P.). 3.

It is the case of the petitioner that she along with two others owned an extent of Ac.3.21 cents of land in Survey Nos.17/2, 49/8 and 52/1 of Tekur Village, West Godavari District. The State Government proposed to acquire the said land for the purpose of Polavaram Project.

Learned counsel for the petitioner submitted that the petitioner submitted objections to respondent Nos.2 and 3. 5.

Learned Government Pleader submitted that respondent Nos.2 and 3 have not passed an award.

The only relief sought by the learned counsel for the petitioner is to direct respondent Nos.2 and 3 to consider the objections of the petitioner dated 26.03.2016. 7.

In view of the submission made by the learned counsel for both parties, respondent Nos.2 and 3 are hereby directed to consider the representation submitted by the petitioner dated 26.03.2016 and pass an award in accordance with law.

Respondent Nos.2 and 3 are hereby directed to issue a notice to the petitioner before considering her objections. If the petitioner fails to appear in pursuance of the notice issued by respondent Nos.2 and 3, they are at liberty to pass appropriate orders in accordance with law.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
