THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.8368 OF 2016 ORDER:

The petitioner/A2 filed this Criminal Petition under Section 482 read with Section 451 Cr.P.C. praying to direct the Station House Officer, Amangal Prohibition and Excise Station, Mahaboobnagar District, to forthwith release the stocks i.e., 30 bags of black jaggery each containing 50 Kgs., total 1500 Kgs. Worth of Rs.15,000/- seized in P.C.O.R.No.108 of 2015-16, by permitting the petitioner to furnish third party surety before the Judicial First Class Magistrate at Kalwakurthy, Mahaboobnagar District.

Heard the learned counsel for the Petitioner and the learned Public Prosecutor and perused the material available on record. Having regard to the facts and circumstances of the case, interim custody of 30 bags of black jaggery each containing 50 Kgs., total 1500 Kgs. Worth of Rs.15,000/- seized in P.C.O.R.No.108 of 2015-16 of Station House Officer, Amangal Prohibition and Excise Station, Mahaboobnagar District, shall be given to the petitioner on his executing a bond for Rs.15,000/- (Rupees Fifteen Thousand only) to the satisfaction of the Judicial First Class Magistrate, Kalwakurthy, Mahaboobnagar District.

Accordingly, the Criminal Petition is disposed of.

Consequently, the miscellaneous petitions pending, if any, shall stand closed.
