This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the Memo Rc.No.B/ 262/ 2019, dated 13.03.2019 issued by the 3rd respondent-Tahsildar, Laxmidevipally and the action of respondent Nos.3 and 4 in not conducting survey and demarcation in respect of land admeasuring Ac.1.26 guntas in Survey No.6, situated at Laxmidevipally Village and Mandal, as arbitrary and illegal. 2.

Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Revenue appearing for the respondents and perused the record.

Learned counsel for the petitioner would submit that though the petitioner has submitted an application on 06.03.2019 for survey and demarcation of aforesaid land, so far no action has been taken by the respondents.

There is no much denial with regard to filing of application, dated 06.03.2019, and payment of requisite fee to conduct survey and fix boundaries of aforesaid land as prayed by the petitioner. When an application is filed and a request is made to conduct survey and fix boundaries, it is appropriate for respondent No.3 to pass suitable orders. The record produced before this Court also shows that so far no action has been taken on the application, dated 06.03.2019, filed by the petitioner.

Under these circumstances, the 3rd respondent-Tahsildar, Laxmidevipally Mandal, Bhadradri Kothagudem District, is directed to dispose of the application, dated 06.03.2019, submitted by the petitioner to conduct survey and demarcation of subject land, in terms of the regulations governing conduct of survey.

With these observations, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
