THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.8195 of 2017 ORDER:
The prayer of petitioners is against inaction of respondents and in concluding the survey initiated in File Nos.E/ 1392/ 26/ 2016 and E/ 1392/ 27/ 2016 dated 06-02-2017 as illegal, arbitrary and unconstitutional.
Mr.Chandra Mohan Reddy for petitioners submits that the delay is occasioned on account of non-co-operation of neighbouring land owners and respondent Nos.3 and 4 have to take early decision on the pending file and communicate to petitioners within reasonable time.
Learned Assistant Government Pleader representing respondents 1 to 4 submits that since a notice is already issued, the petitioners naturally expect a final decision on the notice within reasonable time and requests the Court to dispose of the writ petition by giving sufficient time to respondents 3 and 4 to complete the enquiry initiated in File Nos.E/ 1392/ 26/ 2016 and E/ 1392/ 27/ 2016 dated 06-02-2017.
The statement of the Assistant learned Government Pleader is placed on record.
The writ petition is disposed of by this order. Respondents 3 and 4 are directed to enquire into and conclude the survey taken up in File Nos.E/ 1392/ 26/ 2016 and E/ 1392/ 27/ 2016 dated 06-02-2017, and conclude the survey after
following the procedure stipulated by law, within twelve weeks from the date of receipt of a copy of this order. The petitioners are given liberty to communicate the copy of this order to respondents 3 and 4 for expeditious disposal. The writ petition is disposed of accordingly. No order as to costs.
Miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
