The Court made the following: [order follows] O R D E R :

The learned counsel appearing on behalf of the petitioner seeks permission of this Court to withdraw the Writ Petition on the ground that he got alternative efficacious remedy before the Tribunal/Court below and sought liberty to approach the Tribunal/Court below and prayed to extend the interim order dated 11/4/2016 passed by this Court.

2. Permission is granted with liberty as prayed for.

3. The Writ Petition is accordingly dismissed as withdrawn. No costs. On 11/4/2016 while ordering notice before admission, this Court passed interim direction to the respondents not to remove the machinery and the said direction is in force.

4. Now it is made clear that respondents 1 to 4 shall stop the respondent No.5 from going ahead with the closure proceedings including removal of machinery from the premises of respondent No.5/Nutrine Confectionery Company Private Limited

[Subsidiary of Hershey India Private Limited], Chittoor Plant, Palamaner Road-517002, till the petitioner approaches the Tribunal/Court below within one week from today. However, if the petitioner does not take any steps for availing alternative remedy before the Tribunal/Court below within a week from today, the interim order dated 11/4/2016 passed by this Court shall automatically stands vacated.

5. As a sequel, miscellaneous petitions if any, pending in this Writ Petition shall stand closed.
