HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION Nos.3575 OF 2018 & COMMON ORDER:

Criminal Petition No.3575 of 2018 is filed by the petitioners /A.2 & A.4 whereas Criminal Petition No.3576 of 2018 is filed by the petitioner/A.3 aggrieved by the docket order dated 8th May, 2017 passed by the learned IV Additional District and Sessions Judge, Kurnool in Crl.M.P.No.641 of 2017 and in Crl.M.P.No.642 of 2017 respectively refusing to extend time for the petitioners to surrender before the learned Judicial Magistrate of First Class, Kurnool. It is seen that in Crl.M.P.No.406 of 2017, the petitioners/A.2 and A.4 and in Crl.M.P.No.405 of 2017, petitioner/A.3 were granted anticipatory bail on 7th April, 2017 by the IV Additional District and Sessions Judge, Kurnool, directing the petitioners to surrender before the Judicial Magistrate of I Class, Kurnool within 15 days from the date of the order. They did not surrender as directed but sought for extension which was denied as per the impugned docket orders dated 8th May, 2017. Hence, the present Criminal Petitions.

The submission of learned counsel for petitioners is that the mother-in-law of Accused No.3 who was residing in Pullagummi village died on 12th April, 2017, that was the reason why they could not surrender before the learned Magistrate in compliance of the direction. On this submission, learned counsel sought for extension of time.

Having regard to the above submission, the petitioners are directed to surrender before the Judicial Magistrate of I Class, Kurnool, on or before 3rd April, 2018. The other conditions imposed in the respective bail orders shall hold good. Accordingly, both the Criminal Petitions are disposed of. As a sequel, miscellaneous applications pending if any, shall stand closed.
