THE HON'BLE SRI JUSTICE RAJA ELANGO W.P.M.P. No. 3076 of 2017 in Writ Petition No.45928 of 2016 ORDER :

W.P.M.P. is listed under the caption "for being mentioned". The 6th respondent in the Writ Petition filed the W.P.M.P. under the caption 'for being mentioned" on the ground that the bonds executed by the other person is produced by the writ petitioner i.e., Kunchala Srinivas. The main grievance of the 6th respondent in the Writ Petition - the petitioner herein is that if stocks are returned to the writ petitioner, then he will be in trouble, since relevant bonds are not produced by the writ petitioner.

Admittedly, a case is registered against respondents 5 and 6 in the Writ Petition for the offence under Sections 365 and 384 I.P.C. on the basis of the direction given by this Court. Heard and perused the material available on record. Considering the facts and circumstances of the case, the 6th respondent in the Writ Petition - the petitioner herein is directed to release the stocks in favour of the writ petitioner without insisting for the bonds. If the 5th respondent is aggrieved, he is at liberty to claim any compensation or damages from the writ petitioner in W.P. No.45928 of 2016 by way of approaching the Civil Court.

With the above modification in the order, dated 2.1.2017 passed by this Court in W.P.No.45928 of 2016, the W.P.M.P. is disposed of. _______________________ JUSTICE RAJA ELANGO 27th February, 2017 skmr
