This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioners, who are A2 to A6, in Cr.No.38 of 2018 on the file of the Station House Officer, Challapalli Police Station, Krishna District. The offences alleged are under Sections 403, 405, 408 and 409 of the Indian Penal Code and Section 156(3) of the Criminal Procedure Code. 2.

Heard the counsel for the petitioners and the learned Public Prosecutor appearing for the respondent.

The counsel for the petitioner does not press the petition so far as A2, A3, A5 and A6 are concerned as they are arrested. The allegation against A4 is that she has taken the cheque from A1 to A3 and withdrawn the amount.

The case of the prosecution is that she has to disburse the amount to the loanees. The counsel for the petitioners submits that A4 has not issued the cheque but it was issued by A1 to A3. That seems to be a strange statement. If she is not concerned with the cheque, she ought not to have withdrawn the amount.

Hence, in view of the above, this Court does not find it a fit case for grant of anticipatory bail. However, the petitioner is at liberty to approach the concerned Court having jurisdiction and seek regular bail. On such petition being filed, the concerned Court shall dispose of the same, on merits, on the same day subject to pressure of work.

The criminal petition is dismissed.
