THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.4964 of 2018 ORDER:

This Writ Petition is filed challenging the inaction of the respondents in conducting survey and fixing boundaries in respect of land to an extent of Ac.0.45 cents out of total extent of Ac.0.75 cents, situated in Survey No.483 of Srikantapuram Village, Pulakunta Gram Panchayat, Hindupur Mandal, Ananthapuram District. 2.

Now, learned Government Pleader for Revenue appearing for the respondents produced before this Court the written instructions stating as follows:

"The petitioner herein has present a F-Line Application through registered post on 22.01.2018 by enclosing the Registered Sale Deed No.207/2015 dated 23.01.2015, after verification it is noticed that one Sri Gollapalli Prabhakar Reddy S/o Gollapalli Rami Reddy has sold out the land in Sy.No.483 ExtAc.0.45 cents out of Ac.0.75 cents, out of 2.00 cents out of Ac.4.00 cents of Srikantapuram Village of Hindupur. In fact, the said sale deed is not having any clarity with regard to existing Sub-division letters of this subject land in Sy.No.483-1, 483-2A or 483-2B as discussed above. And also number of civil suits are pending with regard to the land in Sy No.483-2A before the Civil Courts of Hindupur, out of which an Original Suit No.46/2014 on the file of Senior Civil Judge, Hindupur is pending, this case has been posted to 20.02.

2018 for marking of documents and crossing of PWs and DWs. In these circumstances, it is not possible to conduct survey as per the request of the petitioner herein, therefore, the application of the petitioner dated 22.01.2018 has been rejected. With regard to her application, I have to issue Endorsement within 30 days from the date of receipt of the application, and still I am having sufficient time to give Endorsement to the petitioner on or before 22.02.2018, but in hurry the petitioner has filed this writ petition with false and baseless averments.

In view of the above instructions, the fourth respondent is directed to communicate a copy of the Endorsement to the petitioner in order to enable her to take appropriate remedies against the said Endorsement.
